This policy explains what data we collect through the restauracjaparkszwajcaria.pl website, why we collect it, who we pass it on to and how long we keep it. It also covers cookies. We have tried to write it plainly, without the formulas that mean nothing.

1. Who is the controller of your data

The controller of personal data is FHU Sabo Bogdan Szamburski, operating Park Szwajcaria Restaurant, ul. Łabędzka 4F, 44-100 Gliwice. For anything concerning personal data, write to kontakt@restauracjaparkszwajcaria.pl or call one of the numbers listed on the Contact page. We have not appointed a data protection officer, so every request comes straight to us.

2. What data we collect

We collect only what you enter in the form yourself, plus the basic technical data generated on every visit to any website.

From the forms (table booking, event enquiry, room enquiry, general message): your name, e-mail address, phone number, the content of your message and the details of your enquiry, such as the date, time, number of guests or type of event.
From server logs: IP address, date and time of the request, the address of the page visited, browser type. This data is created automatically and serves the upkeep and security of the site.
From cookies: only to the extent described in section 6.

We do not collect special categories of data. If your message contains information going beyond the booking itself, for example about diet or health, we process it solely in order to handle your request. Please do not enter data in the form that is not needed for that purpose.

3. Why we process data and on what basis

Handling bookings and enquiries, meaning getting back to you, confirming a date, agreeing the details of an event or a stay. Basis: Article 6(1)(b) GDPR, steps taken at your request before entering into a contract, and its performance.
Handling other correspondence and establishing, pursuing or defending claims. Basis: Article 6(1)(f) GDPR, our legitimate interest in conducting day-to-day communication and protecting our rights.
Site security, including logs and protecting the forms from spam. Basis: Article 6(1)(f) GDPR.
Tax and accounting obligations, if your enquiry ends in a service for which we issue a sales document. Basis: Article 6(1)(c) GDPR.
Visit statistics, only if you consent to them in the cookie banner. Basis: Article 6(1)(a) GDPR. You can withdraw consent at any time, without affecting what happened before.

Providing data is voluntary, but without an e-mail address or phone number we cannot answer your enquiry, because we would have no way to reach you.

4. Who we pass data on to

A message from the form does not go straight to our inbox. It passes through the services we use, and each of them is a recipient of your data. We list them all, because we think you have a right to know the route your enquiry takes.

Website hosting provider: Google Cloud. The site runs on servers in the European region (Belgium).
Form handling provider: Cognitra, which maintains the mechanism passing form submissions to our mail.
Mail delivery provider: Brevo (Sendinblue SAS, France), through which the submission reaches our mailboxes.
The restaurant's e-mail provider, on whose server our mailboxes are held.
Bodies authorised by law, for example an accounting office or state authorities, if they make a request grounded in law.

We have a data processing agreement with each of these providers. As a rule, the data is processed within the European Economic Area. Some providers belong to corporate groups headquartered outside the EEA. In those cases, transfers take place on the basis of standard contractual clauses approved by the European Commission.

We do not sell data, we do not share it with third parties for marketing purposes, and we do not pass it to other venues or intermediaries.

5. How long we keep data

Correspondence and form submissions: for as long as needed to deal with the matter, and then until any claims become time-barred.
Accounting documents: for the period required by tax and accounting law.
Server logs: for the short period set by the hosting service, for diagnostics and security.
A record of your cookie decision: up to 12 months, or until you clear the site's data in your browser.

6. Cookies

Cookies are small text files your browser saves on your device. We divide them into two groups and treat them differently.

Essential

Needed for the site to work: maintaining the session, protecting the forms from bots and remembering your choice from the cookie banner (stored in the browser's local storage, so we do not have to ask on every visit). These files cannot be switched off on the site, because without them it cannot be used. The law does not require consent for them.

Statistics

These count visits and show which pages are useful. We use Google Analytics for this. The key rule: the analytics script only loads after you click to consent. If you choose essential only, or make no decision at all, no analytics code is run and no statistics file is created. We do not use advertising or tracking cookies for profiling.

How to change your decision

At the bottom of every page there is a Cookie settings link that reopens the choice panel. You can withdraw consent there just as easily as you gave it. You can also delete and block cookies in your browser settings, under privacy or site data.

External content

The site loads typefaces from Google Fonts servers, which means your IP address reaches Google when the page first loads. No cookies are set by this. The offer buttons open PDF documents stored in Google Drive: once you click, you are on a Google page and that service's privacy rules apply. Links to Facebook, Instagram and Google Maps are ordinary links that store nothing until you click them. We do not embed maps, videos or social plugins on the site.

7. Your rights

You have the right to:

access your data and receive a copy of it,
have your data corrected if it is inaccurate or incomplete,
have your data erased when we no longer have grounds to keep it,
restrict processing,
transfer your data to another controller,
object to processing based on our legitimate interest,
withdraw consent to statistics cookies at any time.

To exercise any of these rights, write to kontakt@restauracjaparkszwajcaria.pl. We reply without undue delay, within one month at the latest.

If you believe we are processing your data unlawfully, you can lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warszawa, Poland.

8. Profiling and automated decisions

We do not profile you and we do not make automated decisions about you. Bookings and enquiries are handled by people on our team.

9. Changes to this policy

If we change how the site works, for example by adding a new tool that processes data, we will update this page and change the date at the top. It is worth looking at it before you send a form.

10. Language of this document

This text is a translation of the Polish-language privacy policy. In the event of any discrepancy between language versions, the Polish version, available at /polityka-prywatnosci/, prevails. The controller operates in Poland and is subject to Polish law.
